Keyart — client terms

What we do

Keyart plans, produces and runs paid advertising campaigns for the title or product named in the agreement, across the channels named there.

Ad spend is yours, our fee is ours

Ad spend is billed to you at cost and is not part of our fee. Where Keyart pays a channel on your behalf, that spend is passed through at the amount the channel charged, evidenced by the channel invoice.

Fees

The fee, the option it is based on and the rate card version it was quoted from are recorded in the agreement. Revising the rate card does not change an agreement already made. GST at the prevailing rate is added to every fee.

Minimum budget

Campaigns have a minimum ad budget stated on the rate card. Below it, delivery and reporting are materially less reliable, and we will say so in writing before starting.

Creative ownership

Creative produced for your campaign is yours on payment. Keyart retains the right to show it as portfolio work unless the agreement says otherwise. Creative supplied by you remains yours, and you confirm you hold the rights to it.

What we will not do

We do not copy another rights holder’s creative, and we do not show advertising platforms a different page than the one users see. Both are refused on request.

Reporting

You get access to a dashboard showing spend and results for your campaign, and a report at the end of each phase. Every automated change the system makes to your campaign is recorded with the reason and the rule version that caused it, and is available to you.

Cancellation

Either side may end an engagement with seven days’ written notice. Work done and ad spend committed up to that point is payable. Fixed-term fees are pro-rated by days elapsed.

Platform decisions

Advertising platforms may reject an ad, restrict an account or change their policies without notice and without an appeal we can win. We will tell you promptly and propose an alternative, but we cannot guarantee a platform’s behaviour.
